You represent that you have the legal capacity to enter into this agreement. If you are enrolling on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Prohibited Activities

You may not engage in any activity that disrupts, damages, or interferes with our services or other users' experience. This includes:

  • • Uploading or transmitting malicious code, viruses, or harmful software
  • • Engaging in harassment, bullying, or discriminatory behavior
  • • Violating the intellectual property rights of Pixelcraft or third parties
  • • Using our services for any unlawful or fraudulent purpose
  • • Collecting or storing personal information about other users without consent
  • • Impersonating any person or entity or falsely representing your affiliation

3. Academic Integrity

As an educational institution, we expect all students to maintain high standards of academic integrity. You agree to complete assignments honestly, submit original work, and properly attribute any sources you reference.

Plagiarism, cheating, or any form of academic dishonesty violates these terms and may result in immediate removal from the course without refund. We reserve the right to verify the authenticity of submitted work and investigate suspected violations.

4. Indemnification

You agree to indemnify, defend, and hold harmless Pixelcraft, its instructors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from your violation of these terms, your misuse of our services, or your violation of any law or the rights of a third party.

Disclaimers and Limitation of Liability

1. Educational Outcomes

While we strive to provide high-quality education, we cannot guarantee specific learning outcomes, skill acquisition, or career advancement. Individual results depend on many factors including personal effort, prior experience, learning aptitude, and external circumstances beyond our control.

Our courses are designed to teach web design principles and techniques, but we make no warranty that completion of any course will result in employment, freelance work, career change, or specific professional outcomes. Success in the web design field requires ongoing practice, continued learning, and professional development beyond course completion.

2. Service Warranty Disclaimer

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no warranties about the accuracy, reliability, completeness, or timeliness of the content provided through our services.

3. Limitation of Liability

To the maximum extent permitted by law, Pixelcraft and its instructors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or opportunities, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim, or ¥50,000, whichever is less. Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

4. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, pandemics, government actions, utility failures, or internet disruptions. In such cases, we will make reasonable efforts to resume normal operations as soon as practicable.

Legal Information and Dispute Resolution

1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Your use of our services may also be subject to other local, state, national, or international laws.

2. Jurisdiction and Venue

You agree that any legal action or proceeding arising from or relating to these terms or your use of our services shall be brought exclusively in the courts of Fukuoka, Japan. You consent to the personal jurisdiction of such courts and waive any objection to venue in these courts.

If you are located outside Japan, you acknowledge that by using our services, you are subjecting yourself to the jurisdiction of Japanese courts for the purposes of resolving disputes related to these terms.

3. Dispute Resolution Process

Before initiating any legal proceedings, we encourage you to contact us to seek an informal resolution. Many disputes can be resolved through direct communication. If we cannot reach a resolution within 30 days, either party may pursue formal legal remedies.

For disputes involving amounts below ¥500,000, we prefer to resolve matters through mediation or arbitration rather than litigation. However, either party may seek injunctive relief or other equitable remedies in court when necessary to protect intellectual property or prevent irreparable harm.

4. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these terms. The remaining provisions shall continue in full force and effect.

5. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and Pixelcraft regarding your use of our services. They supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written.

6. Terms Modification

We reserve the right to modify these terms at any time. Material changes will be communicated through our website or via email to enrolled students. The "Last updated" date at the top of this page indicates when changes were last made.

Your continued use of our services after changes become effective constitutes acceptance of the modified terms. If you do not agree with the changes, you must stop using our services and may be eligible for a prorated refund if you are currently enrolled in a course.

7. Waiver

Our failure to enforce any right or provision of these terms shall not be deemed a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by an authorized representative of Pixelcraft.
